Seeds of Life Games operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). Seeds of Life Games is powered by Shopify, which enables us to provide the Services to you.

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason in our discretion. Your order is not accepted until we confirm acceptance.
We must receive and process your payment before your order is accepted. Please review your order carefully before submitting it.
Preorder items may be canceled for a full refund at any time before shipment. Once an order has shipped, it is subject to our Return & Refund Policy, available on our store.
In the event that we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number you provided when placing the order.
You represent and warrant that your purchases are for your own personal or internal use and not for unauthorized commercial resale.
SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be reflected in your order confirmation email.
Unless expressly stated otherwise, posted prices do not include taxes, shipping, handling, customs duties, import taxes, or other governmental charges.
Prices posted in our store may differ from prices offered elsewhere, including by third parties. We may offer promotions from time to time that are governed by separate terms. If there is a conflict between promotion terms and these Terms, the promotion terms will govern.

SECTION 5 - SHIPPING AND DELIVERY
Some products may be offered for preorder. Any stated shipping or delivery date is an estimate only and is not guaranteed.
We are not liable for shipping or delivery delays caused by shipping carriers, customs processing, weather, labor disruptions, supply chain issues, or events outside our reasonable control.
Once we transfer products to the carrier, title and risk of loss pass to you to the extent permitted by applicable law.
You are responsible for providing an accurate shipping address. We are not responsible for orders shipped to an address provided incorrectly by you.

The Services, including but not limited to all trademarks, brands, logos, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement thereof, are owned by Seeds of Life Games, Seeds of Life Creations, LLC, our affiliates, licensors, or partners and are protected by United States and foreign intellectual property laws.

Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product names, service names, designs, and slogans appearing on the Services are the trademarks of their respective owners.

We may provide access to tools offered by third parties that we neither monitor nor control.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Seeds of Life Games is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Seeds of Life Games and not with Shopify.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Seeds of Life Games, including any injury, damage, or loss resulting from purchased products or services.
You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Seeds of Life Games.

(iii) not mimic human behavior or attempt to circumvent CAPTCHAs or similar measures intended to distinguish computers from humans;
(iv) respond truthfully to any question or prompt seeking to determine whether interactions are coming from a human or a computer; and
(v) not circumvent any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

We may terminate or suspend your access to the Services, or any part thereof, at any time and for any reason, without notice.
You remain liable for all amounts due up to and including the date of termination.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SEEDS OF LIFE GAMES, SEEDS OF LIFE CREATIONS, LLC, OUR AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless Seeds of Life Games, Seeds of Life Creations, LLC, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, claims, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

(2) your violation of any law or the rights of any third party; or

We may control the defense and settlement of any such claim at your expense, but we will not settle any claim imposing non-monetary obligations on you without your consent, not to be unreasonably withheld.
